Setting the Stage for Your Team

BC Program Directive
The Government of British Columbia has directed all public bodies to have a privacy management program in place by February 1st, 2023 in accordance with section 36.2 of FOIPPA.
Going forward, the Office of Information & Privacy Commissioner for British Columbia will conduct investigations and audits to examine whether municipalities and regional districts have developed, instituted, and maintained a privacy management program.
FOIPPA Statements
Any data that can be used to identify an individual (examples in the image above) is subject to FOIPPA. This legislation provides guidance for public bodies on how to collect, use and share the personal information of individuals.
It is essential to notify an individual when their personal information is being collected. It must also be disclosed to the individual if their data is intended to be stored, moved, or accessed outside of Canada. If it is securely stored and accessed inside Canada, it is compliant with FOIPPA.
When developing surveys, forms, subscriptions, registrations etc. a statement on the page that is collecting personally identifiable information is required, though it is best practice to place it on every page. For the statement to provide FOIPPA compliance when a public body collects personal information it must inform the individual about:
(a) the purpose for collecting it,
(b) the legal authority for collecting it, and
(c) the title, address and telephone number of an officer or employee of the public body who can answer the individual's questions about the collection.

Review Your Forms & Surveys
When it comes to FOIPPA, a privacy policy alone is not enough. One of the most immediate things you can do is review and update of all your existing forms, surveys, email subscriptions etc. to ensure they include a FOIPPA statement.
As part of this review, best practice dictates that you consider how the information is collected, where it is stored, and how it is accessed. Paper-based and fillable PDF forms (which are often printed out) do not provide the highest level of FOIPPA protection. Many times printed records are easily accessible (and sometimes misplaced) which can accidentally reveal personally identifiable information.
The adoption and use of FOIPPA-compliant, Canadian-based software for forms and surveys are recommended.

Privacy Management Practices
Changes & New Opportunities in Privacy Legislation
In November 2021, the Government of British Columbia enacted Bill 22 to make significant changes to the Freedom of Information and Protection of Privacy Act.
Local governments are required to assign an individual to the role of “Privacy Officer” who will be responsible for developing, implementing, and reporting on their privacy program. Specific regulations have not yet been released however a privacy officer should be prepared to develop a privacy policy, conduct reports for privacy audits, manage privacy training and foster privacy best practices.
We have been preparing for these changes so you can move forward with peace of mind. Over the next few months, we will be releasing various resources to assist privacy officers with this transition. Stay tuned!
